Introduction Costa Rentals

www.costa-rentals.com is the provider of a website on which owners can spend their vacation rentals on our management (both in the short and long term), and on which users (hereafter "Guest") can look, search, send an application or make a booking on Costa Rentals.
Costa Rentals itself is not the owner of the properties displayed on our website, but the rental manager of the holiday homes and therefore only acts as an intermediary between the owner and tenant. All booking contracts are agreed between the Costa Rentals and the Guest.
The homes on our website must all be provided with the permit for the rental of holiday homes and can be requested by us for the owner. If there are already houses without this permit already mentioned, these are in demand. Otherwise we will not place a short-term holiday home on our website in any case.

Conditions to use Costa Rentals

1. Personal use
Costa Rentals can only be used to view, read, search, book and request information about short-term holiday rentals or long-term properties in the list on Costa Rentals, with the aim of renting a property in the short or long term via Costa Rentals or browsing articles and media available on Costa Rentals.
The use of Costa Rentals for purposes other than booking a holiday rental or browsing Costa Rentals is strictly prohibited. The content, such as articles, videos, photos, descriptions, information from owners etc and software and design on Costa Rentals is protected by copyright. The content may not be used or copied for other than personal purposes without the prior written permission of Costa Rentals.

2. Booking a holiday home on Costa Rentals
On Costa Rentals, the Guest is offered two types of properties and depending on the chosen home, the guest can pay by bank transfer or credit card (Visa or Mastercard):
1. The Guest sends an application to Costa Rentals and makes a booking directly with us without the owner being involved. The Guest pays Costa Rentals directly and agrees to the lease agreement of Costa Rentals.
2. The Guest makes a booking on Costa Rentals whereby Costa Rentals acts as an intermediary between the Guest and the Owner. The Guest pays the full rental amount through Costa Rentals and agrees to the rental agreement of Costa Rentals that is submitted to the Guest before a booking is made.
The general conditions on Costa Rentals apply in both cases.
Costa Rentals is a rental manager and not a travel agent, as a result of which every contract entered into to rent a holiday home on Costa Rentals is agreed between the Guest and the Owner. This is on condition that they are both at least 18 years old on the day the property is advertised or booked.

3. Accuracy of information
Both the updated and detailed description of the holiday home, as well as information about the prices, bookings and photos are all provided by Costa Rentals. Costa Rentals continually strives to ensure that the information provided by the home owner is accurate, accurate and corresponds to reality.
Costa Rentals is an online platform and inspects the holiday homes at their physical location or in a meeting with the Owner.

4. Liability
Use of Costa Rentals indicates that the Guest agrees to release Costa Rentals from any case of direct or indirect loss or damage in connection with fraud, phishing, breach of conditions, accidents, strikes, lock-outs or disagreements with the owner. Costa Rentals can not be held responsible for any losses or damage the Guest may experience during the use of Costa Rentals or a stay in one of the holiday homes found or booked through Costa Rentals. Costa Rentals is not obliged to any refund or compensation for direct or indirect damage that the Guest may have suffered as a result of renting or renting a holiday home on Costa Rentals. Costa Rentals only acts as an intermediary between tenant and owner, so that a rental contract or lease can be entered into with Costa Rentals.

5. Varia
The original Spanish version of the terms and conditions, privacy policy, advertising agreement and rental agreement have been translated into other languages. The translated version is only a form of courtesy and office translation and no rights can be derived from the translated versions. In the event of a dispute concerning the content or interpretation of said documents, or inconsistency or contradiction between the Spanish version and another language version of one of the documents mentioned, the Spanish version shall, insofar as permitted by law, prevail and to be decisive. These are the original and valid versions in Spanish.
If a provision of both these terms and conditions or the advertisement and rental agreement is or becomes invalid, unenforceable or non-binding, the remaining provisions will remain in effect.

6. Copyright
The Owner warrants that he owns the copyright on the photographic and textual material supplied to Costa Rentals (hereinafter "the material"), or authorized by the copyright holder to allow Costa Rentals to use the material. The Owner understands that photo or text material from anywhere on Costa Rentals may not be reproduced without the permission of the copyright holder.
The Owner grants Costa Rentals a perpetual, royalty-free license to use the material for promotional purposes. The Owner unconditionally and immediately on request waives Costa Rentals for all costs, loss or liability (including costs for legal representation) that Costa Rentals may incur due to a violation of copyright from the use of the material.
The Owner will immediately compensate Costa Rentals for any costs, loss or liability (including costs for legal representation) that Costa Rentals may incur due to a violation of copyright from the use of the material.

7. Design and layout
Costa Rentals is not responsible for any loss, or damage, resulting from the design of layouts, or changes to the photos and text submitted by the Owner. Costa Rentals reserves the right to set up the final layout design of a vacation rental on Costa Rentals, including the right to edit text, or to change layouts or photos. Costa Rentals also reserves the right to change and edit text data in the Owners' online database.

8. Accuracy of information
Costa Rentals reserves the right to refuse advertisements on any Costa Rentals website whose content does not meet the minimum requirements set by Costa Rentals.

9. Assessment system
Costa Rentals reserves the right to implement an appraisal system for Guests, where they can assess the condition and quality of the homes and Owners. This valuation would be completely free and Costa Rentals is not responsible for any objections arising from the feedback, comments and suggestions made by Guests.

10. Advertising
Costa Rentals reserves the right to also add advertisements, or announcements with references to any kind of content on its website, including advertisements related to other similar holiday homes. Costa Rentals states that the use of this service is completely discretionary, and Owners refrain from submitting claims for damages, or other complaints or claims relating to advertisements published on the website.

11. Multiple dwellings
A holiday home on Costa Rentals belongs to one holiday unit, not multiple units, nor can it be represented as an example of holiday homes. Only one unit needs to be represented in a holiday home, unless permission has been given in advance. Costa Rentals reserves the right to change holiday homes that are not in accordance with this policy.

12. Contact
In order to maintain a consistently high level of service, Costa Rentals requires the availability of all Owners to respond quickly to questions and bookings by e-mail. Costa Rentals reserves the right to suspend advertisements for Holiday Home Owners who are unavailable for more than 24 hours.

13. Payment policy
Online payments with credit card are processed through a third payment provider over a fully encrypted SSL secured line or, if communicated via email, a direct bank transfer. Cash payments are not accepted.

Payments via Costa Rentals happen via a third secure certified payment provider and Costa Rentals does not store the full credit card details and is not liable for errors or losses on payments or money transfers.

14. Changes in prices and conditions
Costa Rentals reserves the right to change the prices and conditions for services offered by Costa Rentals without notice. Changes in the prices will immediately apply and Owners will be informed of this by the website.

15. Documentation
In most cases Costa Rentals asks the Owners to provide proof of the ownership of their property in the form of a proof of ownership, license to rent a holiday home, energy certificate, certificate of habitability, NIE / DNI numbers, place of residence, email address and telephone numbers. If Costa Rentals does not receive sufficient documentation from the Owner or Holiday Home, the approval of an advert of a Holiday Home on Costa Rentals can be rejected. If not in order with one of the above mentioned items, ask us to be of service to you to regularize for this.

16. Legalized holiday homes
In some regions, the Spanish authorities may require by law that Owners obtain a license to legally rent out their holiday home. In these regions Costa Rentals can only approve and advertise a holiday home if the Owner presents a valid license number for the holiday home.

17. Additional conditions
On the Costa Rentals, the Owner can have a house advertised both in the short and the long term. When creating the advertisement, the Owner is requested to accept the conditions that apply to that particular form of advertising.
Costa Rentals reserves the right, at its sole discretion, to change the website, services or these Terms and Conditions, including the rental share, at any time and without notice. If Costa Rentals changes these conditions, it is required to make the change known on the website. By continuing to use or access the website or services after Costa Rentals has notified the change, Owners and Guests indicate that they accept to be bound by these amended Terms and Conditions.
